Description

Dublin City Council gives notice to invoke Article 32.2 (b) for a derogation from tendering where the works, supplies or services can be provided only by a particular economic operator (ii) Competition is absent for technical reasons and (iii) the protection of exclusive rights, including intellectual property rights. Dublin City Council intend to award a contract to Tekenable until July 2025 at a maximum value of €181,000 ex VAT. Although a procurement process for a replacement system as part of a national system is in progress and award of contract is anticipated in Q3 2024, there is currently a requirement to support the existing portal used for the four Dublin Local Authorities. This portal development and initial support was awarded following the use of an EU tendered Framework previously. The supplier has developed the current system and have the relevant intellectual property rights and technical knowledge of the system.
