Description
Dublin City Council gives notice to invoke Article 32(2)(b) of Directive 2014/24/EU which states that the negotiated procedure without prior publication may be used where the works, supplies or services can only be supplied by a particular economic operator for the following reasons (ii) competition is absent for technical reasons, and (iii) the protection of exclusive rights, including intellectual property rights. Dublin City Council intends to directly award a contract for ongoing support and maintenance for the current Housing Management System for a period of six years. As NEC Software Solutions have developed the application and own the Intellectual Property rights, the are the only company that have the technical knowledge and skills to provide support for an essential service. Failure to award such contract would put the continued use of the software at risk resulting in key services being unable to operate and the management of Housing Stock and associated income would also be affected.
