Description
Die Vergabe erfolgt im Verhandlungsverfahren ohne Teilnahmewettbewerb gemäß § 14 Abs. 4 Nr. 2 b) VgV. Der geschätzte Auftragswert überschreitet den EU-Schwellenwert. Das Verfahren wird daher EU-weit bekanntgemacht. Eine Anbindung von Biobanking-Samplern an die vorhandene Siemens/Inpeco-Laborstraße ist ausschließlich mit Systemen des Herstellers Hamilton (STAR/STARlet) möglich. Diese Systeme sind die einzigen, die eine freigegebene, getestete und im Routinebetrieb eingesetzte Schnittstelle besitzen. Systeme anderer Hersteller (z. B. Tecan) verfügen derzeit über keine Anbindung und kein Entwicklungsprojekt. Eine Integration durch Dritte würde einen mehrjährigen Entwicklungsaufwand erfordern und kann nicht innerhalb der Projektlaufzeit (EFRE-Förderung) realisiert werden. Damit liegt ein Fall der technischen Ausschließlichkeit vor. Ein offenes oder nichtoffenes Verfahren würde keinen Wettbewerb erzeugen und wäre rechtswidrig.
