Description
Klepp municipality intends to enter into an intention contract with Coop Klepp Invest AS for the purchase of up to 150 parking lots in the building Coop Klepp Invest AS plans to erect. According to the municipality's assessment, the municipality publishes this voluntary ex ante transparency notice, cf. the Public Procurement Act and regulations, c.f. the Public Procurement Regulations § 2-4 letter a. The provision applies according to wording purchase or hire of existing buildings, but it is a result of fixed case law that the exception may also include the procurement of buildings that have not yet been erected. The premise is that the contract is a real purchase contract or hire contract, and not in reality a building and construction contract.
