Totalförsvarets Forskningsinstitut (FOI) 202100-5182, annonserar i enlighet med LOU (2016:1145) 10 kap § 5, meddelande om frivillig förhandsinsyn, i syfte att försäkra sig om att ingen annan leverantör än H2Hive AB, 559375-2081 kan erbjuda lösning för trycksatt lagring av vätgas i mantlade borrhål till Grindsjön. Motivering till varför upphandlingen inte annonseras: FOI bedömer att endast H2Hive AB, 559375-2081 på grund av skydd av ensamrätt är ensam leverantör för denna unika lösning. Det är en patenterad lösning, ansökans nr 2250143-1, ansökan har accepterats i Sverige. FOI ämnar utreda lagringsbeständigheten för trycksatt vätgas i mantlade borrhål varför inga rimliga alternativa lösningar finns. Således är lösningen unik och bedöms inte föreligga någon konkurrens. Efter genomförande av förhandlat förfarande utan föregående annonsering enligt lag (2016:1145) om offentlig upphandling 6 kap. 14§ punkt 3 och detta meddelande, har FOI för avsikt att ingå avtal med H2Hive AB, 559375-2081 avseende ovan nämnd lösning. Innan avtal tecknas tillämpas avtalsspärr till och med 2024-06-24. Ansökan om överprövning ska skickas till förvaltningsrätten i Stockholm.
