Description
Bei dem Bauvorhaben handelt es sich um einen Neubau i.S.v. Art. 2 Abs. 3 BayBO. Die maßgebliche Höhe des höchstgelegenen Geschosses, in dem Aufenthaltsräume möglich sind, beträgt ca. 4,00 m über der mittleren Geländeoberkante. Gemäß Art. 2 Abs. 3 Nr. 3 BayBO ist das Gebäude demnach in Gebäudeklasse 3 einzuordnen. Es handelt sich zudem nach Art. 2 Abs. 4 Nr. 12 BayBo um einen Sonderbau.
