Description
UT stelt zich op het standpunt dat de opdracht rechtstreeks aan Cohorent Europe B.V. kan worden gegund vanwege het ontbreken van mededinging om technische redenen in de zin van artikel 2.32 lid 1 sub b bullet 2 Aw 2012. Tevens bestaat er volgens de UT geen redelijk alternatief of substituut in de zin van artikel 2.32 lid 3 Aw 2012 dat aan de, hieronder weergegeven, redelijke eisen van de UT kan voldoen: Voor de vervanging van haar Micra TI:Sa femtoseconde laser, stelt de UT dat er in Nederland geen andere organisatie is die dergelijke Laser kan leveren die compatibel zijn met de bestaande Coherent amplifier.
