ProRail past voor deze opdracht een onderhandelingsprocedure zonder aankondiging toe, omdat zij meent gerechtvaardigd een beroep te mogen doen op de uitzondering in Artikel 3.36 lid 1 sub b Aanbestedingswet 2012.
