Description
Two new energy centrals shall be constructed for the production and distribution of cooling as well as connection to district heating to cover the hospitals' need for heating in connection with the realisation of the new Rikshospitalet and new Aker hospitals. An agreement on ownership and operation of the energy centrals is awarded directly to a joint owned company between Oslo University Hospital (OUS) and Hafslund Oslo Celsio, because Celsio due to the obligation to connect in practice has a sole right, cf. FOA § 13-4 (b) no.3.A sole supplier situation occurs as a result of the legislation on concession obliged installations and an approved affiliation obligation in Oslo municipality. Omitting competition must be seen as proportional in this case as OUS as a starting point must pay the affiliation fee and a fixed annual fee to Celsio even if the district heating is not used. Nevertheless, it is not very resource efficient not to use district heating when the connection obligation applies. These are good arguments that there are no "reasonable alternatives".
