Description

Alver municipality shall enter into a framework agreement for the purchase and leasing of vehicles, with an emphasis on purchase. The contracting authority has decided to cancel the competition 2023/8841 Framework agreement for the purchase and leasing of vehicles. Feel the justification for our conclusion. Basis for cancellation of competition It is in the Regulations on Public Procurements (FOA) § 25-4 (1) that "the Contracting Authority can cancel the competition immediately if there is a legal reason". The contracting authority had two tenderers in this competition, but none of them have been rejected. The contracting authority will be left with a valid tender in the competition. The Appeals Board for Public Procurements (KOFA) has stated in several cases that this provides a basis for legal cancellation of competition. In case 2019/329 under point (39), KOFA states that "there is a justifiable reason for cancellation if there is only one remaining tender, considering that there has been a lack of competition for the procurement, see the Appeals Board's decisions in the cases 2010/171, 2014/40 and 2019/630".
